Terms and Conditions

These terms are the agreement between you and GamerSpotter Interactive Inc. ("we", "us") when you use gamerspotter.com and the games on it. By using the site you accept them. They are written to be read, not to be impressive.

1. What the service is

GamerSpotter is a free website with 16 browser games that run on the page. There is no account, no registration and no download. Everything is provided at no charge for personal, non-commercial entertainment.

There is nothing to buy on this site. We take no payments, sell no items or virtual currency, and offer no prizes or rewards of any monetary value. Scores are points and nothing more.

2. Who may use it

Anyone may play. The catalogue is family friendly and there is no age restriction on playing. If you are under the age of majority in your province or territory, please ask a parent or guardian before sending us a message through the contact form, since that involves giving us an email address.

3. Acceptable use

You agree not to:

• copy, mirror, reframe or redistribute our games or their code without written permission;
• attempt to break, overload, probe or gain unauthorised access to the site or its server;
• use automated tools to scrape the site at a rate that degrades it for other people;
• remove or obscure our name, notices or credits from any part of the site;
• use the contact form to send unlawful, threatening or bulk unsolicited material.

Playing a game in an unintended way is not a breach of these terms. Finding a shortcut, exploiting a quirk in the physics or discovering a scoring trick is part of the fun, and we would genuinely like to hear about it.

4. Intellectual property

All games, source code, artwork, text, the GamerSpotter name and the site design are owned by GamerSpotter Interactive Inc. and protected by Canadian and international copyright law. You may link to any page here freely — including deep links to a specific game — and you may quote short extracts with attribution.

You may not embed our games on another website, repackage them into an app, or sell them. If you want to use a game in a classroom, a library, a community centre or a similar setting, just ask; we say yes to that sort of request more or less always.

5. Availability

We aim to keep the site up continuously but we do not guarantee it. Maintenance, hosting problems, network faults and the ordinary hazards of the internet can all interrupt access. We may add, change or retire a game at any time. Nothing here is a paid service, so there is no service credit or refund to claim — but we will always say what changed.

6. Your saved data

Best scores, ratings and preferences are stored by your own browser on your own device, not on our server. We cannot recover them, restore them or move them to another device for you. Clearing your browser data, using private browsing or switching device will lose them. Our Cookie Policy lists exactly what is stored.

7. Disclaimers

The site and the games are provided "as is". To the extent permitted by law we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or compatible with every browser and device — though we test widely and we want to hear about anything that fails.

Games involve repeated keyboard, mouse or touch input. Take breaks, sit comfortably, and stop if you feel discomfort or strain. If you are sensitive to flashing imagery, note that some arcade titles include brief flashing effects on impact.

8. Limitation of liability

To the maximum extent permitted by applicable law, GamerSpotter Interactive Inc. is not liable for indirect, incidental, special or consequential loss arising from your use of this site, including lost data, lost time or device problems. Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.

Some consumer protection legislation in Canada gives you rights that cannot be excluded. Where that applies, these terms are read subject to those rights.

9. External links

Where we link to another website — a regulator, a browser vendor's help page — we do so for reference only. We do not control those sites and are not responsible for their content or their privacy practices.

10. Changes to these terms

We may update these terms as the site changes. The current version is always on this page with its date at the top. Continuing to use the site after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have jurisdiction over any dispute, without affecting any right you may have to bring a claim where you live.
